Terms of use

The rules for using Caravan Domain, in plain English.

These terms apply to everyone who uses caravandomain.com.au or our iPhone app, whether you are browsing, buying or selling. Caravan Domain is run by Bike Domain Pty Ltd (ACN 162 726 972), called "we" or "us" here. Dealers who advertise stock also agree to our dealer terms, which add to these. How we handle personal information is set out in our privacy policy.

By using the site you agree to these terms. If you do not agree, please do not use it.

What Caravan Domain is

Caravan Domain is a classifieds site for caravans and RVs, and their parts and accessories. We publish ads placed by private sellers and dealers and pass messages between buyers and sellers. We are not a dealer: we do not own, inspect or sell the vehicles advertised, and we are not a party to any sale. The contract for a vehicle is between the buyer and the seller.

Accounts

You need an account to place an ad or send some messages. You sign in with a one-time code sent to your email address, or with your Google account. Keep access to your email account secure, because anyone who can read it can sign in as you. You are responsible for what is done through your account. Give us accurate details and keep them up to date.

We may suspend or close an account that breaks these terms, that we reasonably believe is being used for fraud, or that has been inactive for a long time. If we close an account for a reason other than a breach, we will tell you first where we can.

Placing an ad

When you place an ad, you confirm that:

  • you own the vehicle or are authorised to sell it
  • the details, photos and price are accurate and describe the vehicle being sold
  • for a damaged vehicle, the written-off status you give is accurate, and you have given the VIN or chassis number
  • you hold the rights to the photos and text, and they do not show other people without their consent
  • the vehicle is legally yours to sell and is not subject to any undisclosed finance, unless you say so in the ad

Each ad is for one vehicle, or one set of parts described in the ad. Contact details belong in the contact fields, not in the description or the photos. You must not advertise stolen, rebirthed or illegally modified vehicles, or anything the law does not allow to be sold. If you regularly sell vehicles as a business, or reach the number of sales that makes you a dealer under your state's law, you must advertise as a dealer.

Some states treat selling a certain number of vehicles in 12 months as dealing. We count the vehicles a private account has listed with us in 12 months against the lowest number set by any state the account's ads are in. If the ad you submit reaches that number, we tell you and ask you to confirm that the vehicles are your own; if you do, the account is flagged. A nightly check can also flag the account when it reaches that number, without asking you first. While the account is flagged, each new ad from it waits for a person to check it before it goes live, and we may ask you about your other ads. An ad is never rejected automatically for this, and the flag stays until a person reviews the account and lifts it.

On an ad for a damaged, written-off or parts-only vehicle we show the written-off status you give, the state the vehicle was written off in, and that state's rules on registering a written-off vehicle, with a link to the state's own page. A statutory write-off also carries the notice "Statutory write-off: for parts, or not for use on public roads. It cannot be registered." You cannot remove these. Give the status as it is recorded on the written-off vehicle register; if you have not checked the register, choose "not confirmed" rather than guess.

Monthly listing fees and how long an ad stays up

Private ads cost $23 a month for Basic or $35 a month for Premium, and you can cancel at any time. You choose Basic or Premium when you submit the ad. You pay for your first month when you submit your ad, and the month starts then. We check the ad before it goes live, and it goes live once we approve it. If we approve it after your first paid month has ended, which happens only when you have fixed a rejected ad, it goes live once your second month is paid. Basic includes up to 5 photos. Premium includes up to 30 photos, a video, featured placement for as long as the ad is live and the PPSR-checked badge.

The listing renews each month on the same day of the month as your first payment while the ad is live, or on the last day of a month that is too short to have that day. We email you before each renewal with one-click links to confirm the vehicle is still for sale, to mark it sold or to cancel.

You can cancel at any time. The ad then stays up until the end of the month you have already paid for and is not renewed. We do not refund part of a month, except where the law requires a refund. Marking the vehicle as sold also stops the renewal.

If a renewal payment fails, we try it again over the following days and email you. If it still fails, we pause the ad until the renewal is paid, and paying it brings the ad back for the rest of that month. A renewal paid only after its month has ended is refunded in full, because that month can no longer be used; to bring the ad back, pay the current month's renewal. We never delete an ad because a payment failed.

You can upgrade a Basic ad to Premium at any time and pay only the difference for the rest of the month. The difference is worked out on the time left in your current month and charged straight away; Premium applies as soon as it is paid, and from the next month the listing renews at the Premium price. Changing a Premium ad back to Basic is not offered.

Mark the ad as sold, or withdraw it, as soon as the vehicle is sold or no longer available.

Licence to use your ad

You keep ownership of your photos and text. You give us a non-exclusive, royalty-free licence to publish, resize, crop, compress and display them on the site and in search results and feeds that point to the site, for as long as the ad is live and for a reasonable period afterwards (for example, on a "sold" page). We remove embedded location data from photos when we process them.

Checking ads

We check every ad before it goes live, using automated checks and, where they flag something, a person. We may hold an ad, ask you for more information, edit it for category or formatting, or reject or remove it if we reasonably believe it breaks these terms, is misleading or is unsafe for buyers. If an automated check holds or rejects your ad, you can ask for a person to review it; see the privacy policy for how the checks work.

If we can't approve your ad

If we can't approve your ad, we'll tell you why so you can fix it. If a rejected ad is deleted instead, we refund what you paid for it in full. You can edit the ad and send it back to us within 14 days of our decision, or before the end of your first paid month if that comes sooner. Each time we reject an ad that has not yet been live, you get at least 3 days to fix it, except after the third time you send it back once your first paid month has ended. If your time to fix it runs past the end of your first paid month, your listing is not renewed while you fix it: we charge your second month only when the fixed ad goes live, and that month starts then. Within your first paid month you can send the ad back as many times as you need; after that month has ended, you can send it back up to 3 times. You can delete the ad yourself at any time while it stands rejected. If it has not been fixed by the end of that period, or we still can't approve it after the third time you send it back once your first paid month has ended, we delete it. Either way, we refund everything you paid for that ad and its monthly listing ends.

An ad that has not yet been live does not renew, and its second month is charged only if we approve it: if it is still waiting for our first decision on it since you last paid for it when your first paid month ends, we delete it and refund everything you paid for it in full. An ad you have fixed and sent back to us after we rejected it in that paid month is not deleted then: it waits for our decision. If we have asked you for more information about the ad and are still waiting for your answer at that point, the ad ends without a refund, as it would if you withdrew it. You can place it again at any time.

If we approve a fixed ad after your first paid month has ended, we charge your second month to the card you paid with, and the ad goes live once that payment is made. If the payment fails, we try again and email you a link to pay another way; if it is still unpaid 7 days after our first try to take it, the ad ends without a refund, as it would if you withdrew it.

This applies to an ad that has never been live. If we reject a change to an ad that is already live, the other terms on this page apply. If you withdraw or delete an ad before we have rejected it, or after you have sent it back to us and before we decide on it again, that is an ordinary cancellation: the listing is not renewed, and the month you have paid for is not refunded, except where the law requires a refund.

Buyers can report an ad. Reports do not hide an ad automatically, but a person looks at every one.

Paid listings and add-ons

Every private ad is a paid monthly listing, as set out above. Optional add-ons are described with their price before you pay: a bump, on any private ad, and a featured placement, on a Basic ad only, because a Premium ad is already featured. Prices are in Australian dollars and are the total you pay. Payments are processed by Stripe; we do not see or store your card details.

An add-on or upgrade starts once your payment is confirmed. A bump moves your ad back to the top of the results once; a featured placement lasts for the period shown when you buy it; a Premium ad keeps its benefits for as long as it is live on the Premium price. If you have cancelled an ad or marked it sold, we do not offer an upgrade on it, or a featured placement that would run past the day the ad comes down.

Refunds

If we reject an ad that has never been live and it is deleted while it stands rejected, or an ad that has never been live is still waiting for our first decision on it since you last paid for it when its first paid month ends, we refund everything you paid for it in full, as set out under "If we can't approve your ad". If we remove your ad within 14 days of the payment for that month, for a reason that is not your breach of these terms, we refund that month's fee and any add-on that had not finished. Otherwise a month's listing fee is not refunded in part, and add-ons and upgrades are not refundable once they have started, except where the Australian Consumer Law gives you a right to a refund, which these terms do not exclude. To ask about a refund, use the contact form.

Messages, phone numbers and VINs

Enquiries are relayed through the site so buyers do not see sellers' email addresses, and sellers do not see buyers' email addresses unless the buyer chooses to share one. Use messages only to discuss the vehicle or item advertised. Do not send spam, abuse, scams or requests to pay outside a normal sale.

A seller's phone number, and the VIN on damaged, written-off and parts-only ads, are revealed one ad at a time. We limit how many reveals an account or connection can make, and some reveals need a quick check by text message first. Use a revealed number or VIN only for the sale it relates to.

A licensed dealer's ad shows the dealer's business phone number, and, where the dealer's state requires it, the vehicle's registration number or, for a Victorian dealer's unregistered used vehicle, its VIN or chassis number. Use these only for the sale they relate to as well.

Things you must not do

You must not:

  • post false, misleading or duplicate ads, or ads for vehicles or items you do not have
  • use the site to scam, harass or deceive anyone
  • copy ads, photos or data from the site in bulk, or run automated tools against it beyond normal search engine crawling
  • try to get around our limits, checks or security, or access accounts that are not yours
  • upload anything that infringes someone else's rights or contains malicious code
  • post or send objectionable, abusive, hateful or sexual content, in an ad, a photo or a message, on the website or in our iPhone app

We have zero tolerance for objectionable content and abusive users. When such content is reported to us, we remove it and close the account that posted it within 24 hours of the report.

Buying safely

We do not check the vehicles, the sellers' ownership or the buyers' payments. Before you pay, run your own checks: our safety tips explain how. A sale between two private individuals carries fewer consumer guarantees than a sale by a business.

Our liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

Subject to that, we provide the site as it is. We try to keep it available and accurate but do not promise it will always be available or free of errors. We are not responsible for the content of ads, for the condition, ownership or legality of any vehicle or item, or for what buyers and sellers do. To the extent the law allows, our liability to you for any claim about the site is limited to resupplying the service or refunding what you paid us for the listing, add-on or upgrade the claim relates to.

Changes to these terms

We may change these terms when the site or the law changes. We will show the date they were last reviewed below, and if a change materially affects you, we will tell you by email or on the site before it takes effect. Continuing to use the site after a change takes effect means you accept the new terms.

Contact and disputes

Questions or complaints about the site go through the contact form. If a dispute arises, we will try to resolve it with you in good faith first. These terms are governed by the laws of the Australian state in which Bike Domain Pty Ltd has its registered office, and you and we submit to the courts of that state and the Commonwealth.
